Carlos Web Design provides professional website design, website redesign, managed website hosting, website maintenance, performance optimization, security monitoring, and related web development services.
Managed hosting includes website hosting, security monitoring, backups, maintenance, software updates, uptime monitoring, and technical support based on the selected hosting plan.
Hosting services remain active while monthly payments are current. If a payment fails, hosting typically remains active for a grace period of 3 days to allow the payment issue to be resolved. If payment is not received within that time, hosting services may be suspended until payment is made.
Hosting is billed monthly and automatically renews until canceled. Clients may cancel hosting at any time through their client billing portal; cancellation stops future billing but does not refund amounts already paid for the current billing period. Monthly hosting rates may be changed with notice; any rate change takes effect on the next billing cycle unless otherwise agreed. Suspension for non-payment blocks public access to the website but does not delete client data — a client can request an export of their site files, and a reasonable grace period is given before any data is permanently removed for a canceled account.
Some clients may choose to finance the cost of a new website build, along with hosting for an agreed term, through a single recurring monthly payment (a "financed plan") instead of paying separately for design and hosting. Financed plans are subject to a separate written agreement presented and accepted at signup, which governs the plan's term length, pricing, and early-cancellation terms; where that agreement conflicts with these Terms of Service, the financed plan agreement controls for that arrangement.
Clients with hosting or billing accounts are responsible for keeping their login credentials, and any two-factor authentication method enabled on their account, confidential and secure. Carlos Web Design is not responsible for unauthorized access resulting from a client's failure to safeguard their own credentials, but will assist with account recovery where reasonably possible.
Certain optional features (including, but not limited to, SMS/email appointment reminders and AI chat assistants) rely on third-party services that require their own account and subscription, such as an SMS provider or an AI API provider. Carlos Web Design may assist with initial setup and integration of these services, but any ongoing usage costs charged by the third-party provider are the client's responsibility, unless otherwise agreed in writing.
Client Content — logos, images, text, and other materials provided by the client remain the property of the client at all times.
Deliverables — once the website project has been paid in full, ownership of the final website design and the custom code built specifically for that project transfers to the client, unless otherwise agreed in writing.
Carlos Web Design retains ownership of any reusable internal tools, templates, frameworks, and development resources used to build websites, and may reuse general techniques, components, and know-how developed during a project for other clients.
Support is provided according to the client's selected hosting plan. Major redesigns, new custom functionality, or work outside normal maintenance may require a separate estimate.
While every reasonable effort is made to keep websites secure, available, and properly maintained, Carlos Web Design cannot guarantee that services will be completely uninterrupted or free from events outside our control, including internet outages, third-party service interruptions, cyberattacks, or natural disasters.
These Terms of Service are governed by the laws of the State of Maryland, without regard to its conflict of law principles.
These Terms of Service may be updated periodically. Continued use of our services after updates constitutes acceptance of the revised terms.
